SOON offers free delivery and 30 day returns on most orders in major centres. Some items (heavy or large, based on volumetric weight) may carry additional delivery fees.

All deliveries are done using a combination of our networks vehicles and our door-to-door couriers to your chosen delivery address. Products purchased from SOON will be delivered directly to the couple after the wedding.

TERMS OF SERVICE

SOON Sales Agreement

1. SOON Sale Agreement

1.1. The consumer hereby agrees to purchase from the supplier the goods set out in the Schedule to this agreement and to pay to the supplier the amounts set out in this agreement.

1.2. The schedule to this agreement (the “Schedule”) contains the calculation of the purchase price of the goods, the period of payments and forms part of this agreement.

1.3. The parties record that this agreement is an agreement as envisaged in the Consumer Protection Act No.68 of 2008 (CPA) and the CPA is applicable to this agreement, read with inter alia the CPA Regulations (in GN R293 in GG 34180 of 1 April 2011).

1.4. NOTICE: This agreement may be subject to minimum and maximum term(s) of duration, or minimum and/or maximum purchase price and may be restricted to certain particular products, subject to availability, as may be agreed and set out in the Schedule. It is recorded that due to time lapse from the conclusion of the agreement, specifications of goods may improve and in such event the supplier offers and the consumer hereby agrees to accept an upgrade of the particular goods with improved specifications.

2. Payment Of Instalments

2.1. The consumer will not be required to make a SOON down payment.

2.2. Thereafter, the consumer shall make at least one monthly payment for the agreed period towards the settlement of the SOON amount making up the sale price.

2.3. All payments to be made in terms hereof shall be paid into the nominated bank account of the supplier, as detailed in the schedule, or such other bank account as the supplier may specify.

3. Early Settlement

3.1. The consumer is entitled to pay up the full outstanding amount at any time but will be required to wait until the anticipated SOON event date for delivery for purposes of stock management and delivery.

4. Possession, Ownership, Use And Risk Of The Goods

4.1. Possession of the goods will only pass to the consumer once the full SOON amount has been paid.

4.2. The risk regarding loss of or damage to the goods shall pass to the consumer upon delivery of the goods.

5. Interest

5.1. There is no interest, or similar fees or charges payable for the amount paid under this agreement and the National Credit Act 34 of 2005 (the “NCA”) does not apply to this agreement.

6. Consumer’s Right To Terminate The SOON Agreement

6.1. It is recorded that due to time lapse from the conclusion of the agreement prices of goods may increase, requiring an adjustment in the price payable. In the event of an increase in the purchase price of the goods during the course of the agreement, the consumer may exercise the right to terminate the agreement and in such event the amount paid will be refunded as if no agreement was concluded and without any termination penalty payable.

6.2. In the event of the consumer terminating the agreement before fully paying for the goods, or failing to complete the payment for the goods within 30 business days after the anticipated date of completion, the supplier may charge the consumer a termination penalty of one percent (1%) of the full purchase price of the goods to cover bank charges incurred

6.3. The supplier shall on termination by the consumer issue a notice to the consumer to confirm such termination and charge the termination penalty.

6.4. The termination penalty shall not be applicable where the customer’s failure to perform was due to death or hospitalisation and where satisfactory proof such circumstances can be provided.

7. Statement Of Account

7.1. The supplier shall deliver to the consumer a monthly statement of account by way of email or SMS, as may be elected by the consumer.

7.2. The consumer shall be entitled to dispute all or part of any incorrect credit or debit in a statement of account.

7.3. The consumer shall be responsible to ensure that his/her contact details remain up to date and shall immediately advise the supplier of any changes.

8. Supplier’s accountability to consumers – Section 62 of the Consumer Protection Act, 2008

Section 62:

(1)        If a supplier agrees to sell particular goods to a consumer, to accept payment for those goods in periodic instalments, and to hold those goods until the consumer has paid the full price for the goods—

(a)        each amount paid by the consumer to the supplier remains the property of the consumer, and is subject to section 65, until the goods have been delivered to the consumer; and

(b         the particular goods remain at the risk of the supplier until the goods have been delivered to the consumer.

(2)        If a supplier is unable to deliver any goods contemplated in subsection (1) when the consumer has paid the full price for those goods, the supplier must either, at the option of the consumer—

(a)        supply the consumer with an equivalent quantity of goods that are comparable or superior in description, design and quality; or

(b)        refund to the consumer—

(i)         the money paid by the consumer, with interest in accordance with the Prescribed Rate of Interest Act, 1975 (Act No. 55 of 1975), if the inability to supply the goods is due to circumstances beyond the supplier’s control; or

(3)        Without limiting the generality of subsection (2)(b)(i), a failure to supply the goods is not ‘‘due to circumstances beyond the supplier’s control’’ if the shortage results partially, completely, directly or indirectly from a failure on the part of the supplier to adequately and diligently carry out any ordinary or routine matter pertaining to the supplier’s business.

(4)        If a consumer contemplated in subsection (1) terminates the agreement before fully paying for the goods, or fails to complete the payment for the goods within 60 business days after the anticipated date of completion, the supplier—

(a)        may charge a termination penalty in respect of those goods, subject to subsections (5) and (6); and

(b)        after deducting any such termination penalty, must refund to the consumer any amount paid by the consumer under that agreement.

(5)        A cancellation penalty contemplated in subsection (4) may not be charged—

(a)        if the consumer’s failure to complete payment was due to the death or hospitalisation of the consumer; or

(b)        in any other case, unless the supplier informed the consumer of the fact and extent of the penalty before the consumer entered into the lay-by agreement.

(6)        The Minister may prescribe a basis for calculating the maximum amount of a cancellation penalty contemplated in subsection (4).

9. Cession And Assignment

9.1. The consumer shall not cede, assign or transfer any of the rights or obligations in terms of this agreement without prior written consent of the supplier.

9.2. The supplier shall be entitled to cede assign and/or transfer its rights and obligations under this agreement and its ownership of the goods. The consumer agrees that upon such cession, assignment or transfer, he/she shall hold the goods on the basis that the ownership in the goods has passed to the cessionary, assignee or transferee.

10. Addresses For Receiving Of Documents

10.1. All process (including summonses), documents, pleadings and notices relating to this agreement shall be served or given to the supplier at 51 Ernie Els BLVD Peach Tree Mnandi 0149

10.2. All process (including summonses), documents, pleadings and notices relating to this agreement may be served or given to the consumer at the address mentioned in the schedule to agreement, unless such address has been changed in writing as provided hereunder.

10.3. As such, the parties choose the aforesaid addresses as their respective domicilia citandi (an address where service of the aforesaid documents may be effected).

10.4. Either party to this agreement may change their address by delivering to the other party a written notice of the new address by hand, registered mail or electronic mail.

11. General

11.1. The consumer confirms that this agreement is in one of the official languages that he/she understands and acknowledges that he/she received a copy of the agreement in an official language which he/she requested.

11.2. The consumer confirms and acknowledges that the terms and conditions of this agreement, including the Schedule and his/her obligations there under, have been explained to him/her and that he/she understands them in full and agrees to them.

11.3. References in this agreement to the singular shall include the plural and vice versa and references to the masculine gender shall include the feminine and neuter genders and vice versa.

11.4. Each clause of this agreement shall be severable from the remainder of the agreement and should any clause in this agreement be found to be invalid, such invalidity shall not affect the validity of the remainder of the agreement.

11.5. This agreement, including and consisting of the schedule and the terms and conditions of the agreement, constitutes the entire agreement between the parties and no amendment, alteration, consensual cancellation or waiver shall be valid or binding on the parties unless reduced to writing and signed by the consumer and an authorised representative of the supplier.

11.6. The consumer hereby warrants that the information supplied in the application is correct.

 

Privacy Policy

1. INTRODUCTION

SOON recognises the importance of protecting the personal information that you (“the User”) provide to us. Therefore, we have put together, and endeavour to follow this policy that respects and addresses that.

2. INFORMATION COLLECTION

2.1 SOON collects information from the User at several different points on the Site. SOON is the sole owner of the information collected on SOON‘s web site (“the Site”). We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

2.2 Consent to collect information can be express (eg. signing an agreement) or implied (eg. if the User is given an opportunity to opt-out of a specific form of information sharing, but chooses not to do so, SOON implies that the User chooses to share this information with us).

2.3 SOON processes personal information on web hosting servers which may not be in your present country.

3. INFORMATION WE COLLECT

In the course of service provision to the User we may collect certain forms of information. The types of information that we may collect are detailed below:

  • Information you provide – When you register for an account on SOON by completing the appropriate form, we ask you for personal information (such as your name, email address and phone number). We may combine the information you submit under your account with information from other services or third parties in order to provide you with a better experience and to improve the quality of our service.
  • Financial Information – In the course of providing a service to you, SOON may ask for financial information (Bank account details, credit card details etc.). Such information will be treated with the upmost privacy, will be stored encrypted on our systems, will only be communicated across a secure link and will not be provided to any third parties except where necessary to provide SOON‘s service to you.
  • Cookies – When you visit SOON, we may send one or more cookies – a small file containing a string of characters – to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences or storing session information. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.   • Log information – When you use SOON, our server automatically records information that your browser sends whenever you visit a website.   • Other sites – This Privacy Policy only applies to SOON. We do not exercise control over any third party sites who we have partnered with to deliver a service to you. 4.1 SOON collects user information for the purposes described below:

5. COMMUNICATIONS

5.1 SOON may send the User, site and service announcement updates on an irregular basis. Users are not able to unsubscribe from service announcements, which contain important information about our service.

5.2 On occasion SOON will email newsletters to provide the User with information that we think the User will find useful, including information about new products and services. We might also contact the User by email to see if the User is interested in participating in market research regarding SOON. We may also contact the User by email to respond to customer-service complaints that the User has submitted, to address a problem affecting the User’s use of the service or to verify the User’s account information if the User submits a password request.

6. INFORMATION SHARING

6.1 SOON may share aggregate demographic information with our advertisers or information collection companies, but will not reveal any personally identifiable information in these instances. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. We may also partner with third parties to provide specific services. When the User signs up for these services, we will share the information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

6.2 SOON may share a User’s contact information with other registered Users for the purposes of resolving support queries relating to SOON or the service provided to a User by another User. This contact information includes, but is not limited to, name, surname, email address and phone number. Typically, this would be providing a buyer’s contact details to a seller or vice versa, where SOON has the necessary information to assist, but cannot actually resolve a support query.

6.3 We will not voluntarily disclose any information about individual users, except as described in this Privacy Policy, or to comply with applicable laws or valid legal process, or to protect the rights or property of SOON or others, to assist our email vendor with resolving complaints about unsolicited email, or as otherwise described in this Privacy Policy.

7. DATA INTEGRITY

SOON processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary and possible.

8. INFORMATION SECURITY

8.1 We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. The servers that we store personally identifiable information on are kept in a secure environment.

8.2 We restrict access to personal information to SOON employees who need to know that information in order to operate, develop or improve our services.

9. ACQUISITION OR MERGER

It is possible that SOON and/or any of our assets may be acquired in an acquisition or a merger. In such a transaction, customer information may be transferred to the acquiring entity. While we will endeavour to require the successor company to maintain this Privacy Policy, we cannot guarantee that this policy will remain in effect after such a corporate action.

10. NOTIFICATION OF CHANGES

10.1 This policy may be revised over time as new features are added to the Web site and/or as changes are required due to changing circumstances. We will post our new Privacy Policy, along with the date of its last revision, prominently so that the User will always know what information we gather, how we might use that information, and whether we will disclose it to anyone.

10.2 SOON is, however, under no obligation to inform the User of such changes when they happen, although it is assumed that any changes will be minor and will not fundamentally impact the User. Should the change be deemed by SOON to be significant, we will endeavour to inform the User of these changes through whatever means we deem necessary (banner on home page, email notification etc.) in a timely manner.

Our policy lasts 30 days. If 30 days have gone by since your ultimate purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.


If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)


If you haven’t received a refund yet, first check your bank account again.
Then contact your payment company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)

Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

Extend Warranty

Let us know if you would like to extend your warranty beyond that of the standard warranty period offered by the manufactures for a nominal fee of 10% of your purchase value you would be able to extend your warranty up to an extra three years.
